WHAT IS TITLE INSURANCE?
Anytime a property is sold or financed, there are public records of the transaction. There are also records that may affect the ownership of a property (liens, judgements, levies, encumbrances, etc.). Title insurance protects owners and lenders against financial loss from liens, encumbrances or other defects in the title of the property, except those listed as exclusions in the policy.
Title insurance is purchased at the time of the transaction and insures against events that occurred in the past history of the property.
The owner’s policy protects the new owner for as long as the buyer owns the property, and a lender’s policy insures the lender’s interest in the property for as long as the loan is outstanding.
The process starts with the Title Company / Escrow Officer opening title.
Then the title agent will do a title search of the specified property by going through title data information from previous transactions and public records to determine the title history of the property.
Once the history is determined, a title commitment, which shows ownership interests, liens, encumbrances or defects with the property, will be sent to the client for review.
The title agent will work with the sellers to remove any title defects in order to get a clear title.
Finally, the title agent will provide a title insurance policy that will protect the client from a number of issues that might have not been known or determinable at the time of the transaction.
